Reasons Josh Duggar Will Likely Face Maximum Prison

Beverly Hills family and criminal lawyer Adam Michael Sacks provided some legal advice for The Sun and said that he sees Josh Duggar being handed the biggest sentence of the guidelines of the Federal Sentencing Table, with the criminal record and the age of the victims factoring into the decision-making process. According to Sacks however, even though the formula for sentencing is the deciding factor in the length of time Duggar will be in prison the judge might decide to recommend the most severe punishment due to of his previous work as a TV host. In his own words:

For Josh I think Josh will be given a more severe sentence. The courts don’t want with the possibility of being accused of giving someone special treatment, and simply slapping the wrist. Judges could claim that people were admiring you. You were on TV. You could have set an example to the viewers.’

Celebrities who get into legal trouble are criticized and outcries when the circumstances end without the infamous offenders being held accountable for any actions. (Often when it comes to DUIs or domestic disputes, but they’re not the only ones.) However, from his perspective, Adam Michael Sacks thinks that the judge in this case is likely to want to stay clear of any notion of favoritism with regard the case of Josh Duggar, in the sense of granting him a lesser sentence.

For sure, Sacks views regarding the subject aren’t an accurate representation of the gospel and he’s not able to be certain of how the sentencing process will play out. However, his theories are, at the very least, well-informed and he admits that the situation could turn in the opposite direction when the judge is truly compassionate.

If the judge believes the judge is worth savingmoney, he’ll choose the lower end of the spectrum. If Josh exhibits a negative attitude when in court, or is influenced by statements made by victims and remark, he’ll go for the higher end of the spectrum.

In light of the serious and sensitive nature of the crimes Josh Duggar was found guilty of, it’s likely to cause shock when the judge decides to go with the light side of the range of sentencing. Particularly since no apology or acknowledgement of responsibility has been shown, even as Duggar’s ex- 19 Kids and Counting actor as well as his lawyers have attempted at unsuccessful attempt at appealing every decision which doesn’t work in his direction.

The most recent approach, with the motion to reopen the trial towards the beginning of February 2022 is to assert that no evidence exists to show that Duggar personally saw the material containing child p*rnography that is at the heart of the investigation. The case is framed and pointing a finger towards Caleb Williams, an alleged former lover of Jana Duggar whom Duggar’s lawyers claim was able to access the computer located at the Duggar’s car dealer as well as the password for the device.

Williams was not present during the two-week trial which ended in December 2021. the papers filed claim that this was not an equitable decision. It’s unclear if these arguments could be used to refute evidence relating the Duggar’s iPhone 8 that was an investigation catalyst.

Just spent his birthday celebration behind bars, Josh Duggar will be sentenced on April 5, 2022.
